1. General Provisions

These terms and conditions govern the rights and obligations between the seller and the buyer in the sale of goods through the website www.emreis.cz.

These terms comply with:

  • Act No. 89/2012 Coll., the Civil Code,
  • Act No. 634/1992 Coll., on Consumer Protection,
  • Regulation (EU) 2016/679 (GDPR) of the European Parliament and of the Council.

2. Orders and Conclusion of the Contract

  1. The website www.emreis.cz is not a traditional e-shop with automated payments.
  2. The buyer selects goods in the shop and fills in the order form (name, address, phone number, delivery and payment method).
  3. Once the form is submitted, the order is processed and the buyer receives a confirmation by e-mail or phone.
  4. The contract between the seller and the buyer is concluded by submitting the order form.
  5. An invoice for each order is issued by the seller through the Bitfaktura.cz system.

3. Payment and Delivery Terms

  1. Payment can be made via PayPal, by bank transfer or cash on delivery. Cash on delivery is available only within the Czech Republic. For bank transfer and PayPal, we will send the buyer payment instructions by e-mail once the order has been received.
  2. Goods are shipped via the selected carrier (e.g. Zásilkovna, Balíkovna, PPL).
  3. The delivery period is up to 14 days, unless stated otherwise. For international orders, the delivery period is up to 30 days.
  4. Prices include VAT — in Czech crowns (CZK) on the Czech version of the website and in euros (€) on the English version.
  5. For orders to countries without a listed shipping price, the buyer will be contacted by e-mail after placing the order and the shipping cost will be arranged individually.

4. Complaints and Returns

  1. The buyer has the right to make a claim for defective goods in accordance with the applicable legislation.
  2. Complaints can be submitted by e-mail to orders@emreis.cz.
  3. If a complaint is accepted, the goods will be repaired, replaced or the payment will be refunded.
  4. The buyer has the right to withdraw from the contract within 14 days of receiving the goods without giving a reason.
  5. Returned goods must be undamaged, in their original packaging and sent back to the seller’s address.
  6. The cost of returning the goods is borne by the buyer.

5. Personal Data Protection

  1. The seller processes personal data in accordance with the GDPR. Personal data is processed solely for the purpose of fulfilling the order and is not provided to third parties, except for shipping carriers, the invoicing system Bitfaktura.cz and — when paying via PayPal — PayPal.
  2. If the buyer voluntarily consents to receiving the newsletter, their e-mail address and other necessary identification data may also be used for sending marketing communications related to the band Emrei’s.
  3. For this purpose, such data may be transferred to the e-mail marketing provider Ecomail.cz, which acts as a data processor and complies with GDPR requirements.
  4. Consent is voluntary and may be withdrawn at any time via the unsubscribe link included in every e-mail or by contacting the seller.

6. Final Provisions

  1. These terms and conditions are valid from 1 August 2024.
  2. The seller reserves the right to amend these terms and conditions at any time.
